<p>Check out the decor at the new Besaw's, opening tomorrow in Northwest.</p> <p>One of the oldest restaurants in Portland has successfully <a href="http://pdx.eater.com/2015/4/28/8507703/besaws-closing-lease-relocation">survived losing its lease</a> and <a href="http://pdx.eater.com/2015/6/16/8792061/cana-flug-keeps-besaws-name">a legal battle</a> to keep its name, and tomorrow, <a href="http://pdx.eater.com/venue/besaws">Besaw's</a> will reopen after being closed for eight months. Owner <strong>Cana Flug</strong> tells Eater the new Besaw's will feature lots of custom work, with custom wallpaper and light fixtures, and as the pictures show, Besaw's will have an open kitchen and a huge bar in the center of the room with seating on three sides.</p>
<p>Beginning tomorrow, Besaw's will serve brunch and dinner seven days a week. Monday through Friday, it will serve brunch from 7 a.m. to 3 p.m., and Saturday and Sunday it will serve brunch from 8 a.m. to 3 p.m. Dinner will be served 5 to 10 p.m. nightly.</p>

<p>Dustin Clark, former chef of Wildwood, has updated the menu with an eye toward tradition.</p> <p>Sharpen your teeth. <a href="http://pdx.eater.com/venue/besaws">Besaw's</a> is poised to reopen Wednesday. And along with a new location at 1545 NW 21st, the new Besaw's will feature the talented <a href="http://pdx.eater.com/search?q=dustin+clark">Dustin Clark</a>, former chef at the legendary <a href="http://pdx.eater.com/tags/wildwood">Wildwood</a> restaurant. Clark and Besaw's owner <a href="http://pdx.eater.com/tags/cana-flug">Cana Flug</a> actually worked together at Wildwood, and their reunion has prompted many to ask: Will the new Besaw's mark the return of Wildwood's most beloved dishes?</p>
<p>Speaking with Eater, Clark says he's bringing Wildwood's sourcing philosophy to Besaw's but that the menu will stick to Besaw's classics for the most part. That means you'll find a single breakfast, lunch, and brunch menu served daily from morning till 3 p.m., and you'll recognize most of the dishes: The breakfast burritos, huevos rancheros, and farmers hashes aren't going anywhere. Clark says, "Where you can go and refine and tighten flavors is through sourcing, to get the best product as possible."<span> </span></p>
<p><span>Beyond sourcing, he has added a few new dishes, including a breakfast paella and waffle-crusted chicken wings. Moving forward, he'll test the waters to see whether diners want other new dishes through daily specials, too.</span></p>
<p><span>As for dinner, it's "the realm I'm most excited about," says Clark. Clark says he likes the freedom at Besaw's, where he isn't tied to a specific cuisine, and he subtly adds new flavors to give classic dishes pop; in some cases, he swaps fish sauce for sea salt, and he's also updated the restaurant's signature meatloaf, adding ground pork in addition to ground beef. </span><span>After Wednesday, Besaw's will serve dinner daily from 5 to 10 p.m. </span></p>

<p>The 112-year-old restaurant is moving in just around the corner from its original location.</p> <p>Owner <a href="http://pdx.eater.com/tags/cana-flug">Cana Flug</a> tells Eater that <a href="http://pdx.eater.com/venue/besaws">Besaw's</a> will officially reopen at its new location at NW 21st & Raleigh (a couple blocks from St. Jack) on January 14, 2016. Besaw's closed in spring 2015, and <a href="http://pdx.eater.com/2015/6/16/8792061/cana-flug-keeps-besaws-name">after a legal battle with developer C. E. John Inc.</a>, Flug retained the right to the Besaw's name. The new Besaw's will have many familiar faces, with Flug estimating about ninety-percent of her staff made the move with her.</p>
<p><span>The new faces at the restaurant will be familiar to many, too: </span><a href="http://pdx.eater.com/search?q=dustin+clark">Dustin Clark</a><span>, the former executive chef of </span><a href="http://pdx.eater.com/2014/2/18/6277199/wildwood-will-close-next-week-after-20-year-run">Wildwood</a><span>, will helm the kitchen, and <b>Savanna Ray</b>, the former Wildwood sommelier, is managing the bar program. </span><span>Flug says that around fifteen former Wildwood staff have joined Besaw's and that Clark will actually bring back some Wildwood dishes. </span><span>The new Besaw's will be a more casual neighborhood spot, with a menu that "meets Wildwood in the middle," says Flug. </span></p>
<p>Flug is also opening a smaller restaurant next door to Besaw's called<b> Solo Club</b>, which she anticipates opening a month after Besaw's.</p>

<p>The Northwest dining spot has been on hiatus for three months.</p> <p>After losing its long-time location and <a href="http://pdx.eater.com/2015/6/16/8792061/cana-flug-keeps-besaws-name" target="_blank">a legal battle over who owns the name</a>, <a href="http://pdx.eater.com/venue/besaws" target="_blank"><b>Besaw's</b></a> will reopen on the corner of NW 21st and Raleigh in the new LL Hawkins building. <a href="http://pdx.eater.com/2015/6/16/8792061/cana-flug-keeps-besaws-name" target="_blank">As previously reported</a>, owner Cana Flug retains ownership of the restaurant name, and <span>the new location is just a couple blocks away from the old location.</span></p>
<p>Flug announced by press release that she has joined forces with Urban Works, Meriwether Group, Cairn Pacific, and Capstone Partners and is exploring the potential of her new space. She wrote, "Hollandaise every day! Happy hour! Family supper! We’ve missed you!" And chef Michael Uhnak will reportedly stick to many of the Besaw classics while adding some new items.</p>
<p>Flug will open an additional restaurant next door to Besaw's, but she has not released specifics.</p>
<p>As far as timing, Besaw's aims to open in time for the 2015 holidays.</p>

<p>The new and improved Besaw’s could open by late summer in a location that’s just a stone’s throw from the original spot.</p> <p>After months of <a href="http://pdx.eater.com/2015/5/1/8532437/besaws-restaurant-lawsuit-landord-ce-john-trademark-dispute">legal wrangling</a>, <a href="http://www.besaws.com/#welcome">Besaw's</a> owner <b>Cana Flug</b> has reached a settlement with developers C.E. John over who keeps the Besaw's name going forward.</p>
<p>In a way, both will: C.E. John can still call his future development—which includes the former 112-year-old Besaw's space—the Besaw's building, but Flug will take the Besaw's name, brand, logo and history with her when she relocates the restaurant to a new space just a few blocks away.</p>
<p>Flug's keeping mum on exactly where the new Besaw's will land, but she says she nearly finished with the design, and says she could sign the new lease as early as the end of this week.</p>
<p>The settlement ends months of contention, some of it fierce: Earlier this month, <a href="http://www.golocalpdx.com/news/legal-battle-over-besaws-building-gets-bigger">GoLocalPDX reported</a> that C.E. John landlord Jim John likened Flug's removal of remnants of the property was like "Isis and Syria."</p>
<p>Those remnants—an awning, vintage glass and the restaurant bar's original barstools and lights—will migrate to the new Besaw's when it opens later this summer.</p>
<p>As for the food, Flug says regulars should expect more of the same.</p>
<p>"It's a new bean," Flug says, "but we're going to stay true to who we are, and just offer good food.</p>

<p>The lease woes and trademark disagreement take a turn for the courts. </p> <p>The trademark disagreement that's at the crux of why a <a target="_blank" href="http://pdx.eater.com/2015/4/28/8507703/besaws-closing-lease-relocation">Portland icon has lost its lease</a> after nearly 112 years in the same location is now going to court.</p>
<p>To recap: News broke on Monday that <a target="_blank" href="http://pdx.eater.com/venue/besaws">Besaw's</a> restaurant was being forced to move because the building's owners, who have plans to redevelop the building, refused to renew the restaurant's lease after several years of negotiations with restaurant owner <b>Cana Flug</b>, who bought the business in 2005. But later that day, details of a trademark dispute came to light. The landlord, C.E. John Inc., claims the Besaw's name comes with the building and filed a trademark application in January. Flug disagrees, saying she bought the name when she bought the business, and filed her own trademark application in March as a result. The landlord then refused to renew the lease, which ends May 31.</p>
<p>Flug has been actively searching for a new location for Besaw's within the neighborhood. But Jeff Thompson, C.E. John co-president, said the company plans to find another restaurateur to re-open a restaurant called Besaw's in the same location.</p>
<p>So<b> </b>Flug has filed a lawsuit against C.E. John, asking the <b>court to decide who is the rightful owner of the Besaw's name</b>. <span>The lawsuit details the business transactions and lease agreements leading up to this point, and makes a case that, according to trademark law, the name belongs to the restaurant owner.</span></p>

<p>"When the current owner, my client, bought the restaurant in 2005, what she purchased was the goodwill and the name of the restaurant," says Flug's lawyer <b>Dennis Steinman</b> of Kell, Alterman & Runstein. That should be pretty clear-cut, but the building's previous owner added a section to the lease that says the landlord grants the tenant the right to use the name for as long as they're a tenant.</p>
<p>"The problem is the trademark, under trademark law, always goes with the goods and services that you offer," says Steinman. "Trademarks are always associated with the goodwill of a business and not a real property. They're associated with the kinds of things offered to consumers like breakfast, lunch and dinner. <b>The claim that the name only goes with whoever is in the location is contrary to the concept of what trademarks are all about.</b>"</p>
<p>Of course, someone could trademark a name and license it for use, "but they maintain really tight control over how someone is using it," says Steinman. "In this case the building owners collected rent and that's all they did."</p>
<p>Under Flug's ownership, Besaw's has grown from a quiet breakfast and lunch spot to a full-fledged neighborhood destination with dinner service. "I think what's important is that my client has continuously operated a business under that name for 10 years now, and purchased that right from the prior owner, and has built it up into a really great restaurant. She deserves to keep the goodwill of the business she built up."</p>
